color: red; }div.Section0 { }div.Section1 { }<br> 2019年9月3日，商务部发布2019年第37号公告，决定自2019年9月6日起，对原产于美国、欧盟、韩国、日本和泰国的进口苯酚征收反倾销税，反倾销税率分别为美国公司244.3%—287.2%，欧盟公司30.4%，韩国公司12.5%—23.7%，日本公司19.3%—27.0%，泰国公司10.6%—28.6%，实施期限为5年。<br> 2021年1月29日，商务部发布2021年第3号公告，根据该公告，2020年12月31日英国脱欧过渡期结束后，之前已对欧盟实施的贸易救济措施继续适用于欧盟和英国，实施期限不变；该日期后对欧盟新发起的贸易救济调查及复审案件，不再将英国作为欧盟成员国处理。<br> 2023年4月26日，商务部发布2023年第15号公告，决定由泰国国家石油全球化学股份有限公司继承PTT苯酚有限公司在苯酚反倾销措施中所适用的税率及其他权利义务。<br> 2024年9月5日，应中国苯酚产业申请，商务部发布2024年第36号公告，决定自2024年9月6日起对原产于美国、欧盟、韩国、日本和泰国的进口苯酚所适用的反倾销措施进行期终复审调查。申请人未对原产于英国的进口苯酚所适用的反倾销措施提起期终复审调查申请，自2024年9月6日起，对原产于英国的进口苯酚所适用的反倾销措施到期终止。<br> 商务部对如果终止反倾销措施，原产于美国、欧盟、韩国、日本和泰国的进口苯酚倾销继续或再度发生的可能性，以及对中国苯酚产业造成的损害继续或再度发生的可能性进行了调查。根据调查结果，并依据《中华人民共和国反倾销条例》（以下称《反倾销条例》）第四十八条，商务部作出复审裁定（见附件）。现将有关事项公告如下：<br> 一、复审裁定<br> 商务部裁定，如果终止反倾销措施，原产于美国、欧盟、韩国、日本和泰国的进口苯酚对中国的倾销可能继续或再度发生，对中国苯酚产业造成的损害可能继续或再度发生。<br> 二、反倾销措施<br> 依据《反倾销条例》第五十条的规定，商务部根据调查结果向国务院关税税则委员会提出继续实施反倾销措施的建议。国务院关税税则委员会根据商务部的建议作出决定，自2025年8月29日起，对原产于美国、欧盟、韩国、日本和泰国的进口苯酚继续征收反倾销税，实施期限为5年。<br> 征收反倾销税的产品范围是原反倾销措施所适用的产品，与商务部2019年第37号公告中的产品范围一致。具体如下：<br> 产品名称：苯酚<br> 英文名称：Phenol<br> 化学分子式：C6H5OH<br> 化学结构式：<br> 产品描述：苯酚在常温下通常为无色针状或白色块状晶体，溶于酒精、乙醚、氯仿、甘油、二硫化碳，在室温时稍溶于水，几乎不溶于石油醚，腐蚀力强，可燃。<br> 主要用途：苯酚是重要的有机化工原料，主要用于制备酚醛树脂、双酚A、己内酰胺、烷基酚、水杨酸等工业原料，还可以用作溶剂、试剂和消毒剂，广泛运用于合成纤维、塑料、医药、农药、香料、染料、涂料和炼油工业等领域。 <br> 该产品归在《中华人民共和国进出口税则》：29071110。<br> 根据商务部2019年第37号公告和2023年第15号公告的规定，各公司的反倾销税税率如下：<br> 美国公司：<br> 1. 英力士美国公司 287.2%<br> （INEOS Americas LLC）<br> 2. 美国兰科运营有限责任公司 244.3%<br> （Blue Cube Operations LLC）<br> 3. 其他美国公司 287.2% <br> 欧盟公司： <br> 所有欧盟公司 30.4%<br> 韩国公司：<br> 1. 锦湖P&B化学株式会社 12.5%<br> （KUMHO P&B CHEMICALS, INC.）<br> 2. （株）LG化学 12.6%<br> （LG CHEM, LTD.）<br> 3. 其他韩国公司 23.7%<br> 日本公司：<br> 1. 三井化学株式会社 19.3%<br> （Mitsui Chemicals, Inc.）<br> 2. 其他日本公司 27.0%<br> 泰国公司：<br> 1. 泰国国家石油全球化学股份有限公司 10.6%<br> （PTT Global Chemical Public Company Limited）<br> 2. 其他泰国公司 28.6%<br> 三、征收反倾销税的方法<br> 自2025年8月29日起，进口经营者在进口原产于美国、欧盟、韩国、日本和泰国的进口苯酚时，应向中华人民共和国海关缴纳相应的反倾销税。反倾销税以海关确定进口货物的计税价格从价计征，计算公式为：反倾销税税额＝海关确定进口货物的计税价格×反倾销税税率。进口环节增值税以海关确定进口货物的计税价格加上关税和反倾销税作为计税价格从价计征。<br> 四、行政复议和行政诉讼<br> 根据《反倾销条例》第五十三条，对本复审决定不服的，可以依法申请行政复议，也可以依法向人民法院提起诉讼。<br> 五、本公告自2025年8月29日起执行<br> 附件：中华人民共和国商务部关于原产于美国、欧盟、韩 国、日本和泰国的进口苯酚所适用反倾销措施的期终复审裁定.pdf <br> 商务部<br> 2025年8月28日<br> @font-face {<br> font-family: "Times New Roman";<br> }@font-face {<br> font-family: "宋体";<br> }@font-face {<br> font-family: "Calibri";<br> }@font-face {<br> font-family: "Cambria";<br> }@font-face {<br> font-family: "仿宋_GB2312";<br> }@font-face {<br> font-family: "黑体";<br> }p.MsoNormal { margin: 0pt 0pt 0.0001pt;
