} window.__cms_video_player_instances__.push(new Aliplayer(playerOpt)); window.__cms_viedo_player_opts__.push(playerOpt); 4月16日下午，深圳市人力资源和社会保障局以“深圳新政‘单工伤’的那些事——我为群众办实事”为主题，采取“线上+线下”相结合方式，举办了新业态从业人员等特定人员自愿单项参加工伤保险政策宣贯活动。活动现场气氛热烈，形式新颖、接地气，人民群众既可以随时随地用手机观看直播或回放，也可以在直播间提问，还可以到活动现场面对面咨询，通过喜闻乐见的方式把工伤保险新政策讲清楚、讲明白，受到人民群众的热烈欢迎，让人民群众得到真真切切的实惠。主题活动线上有6000多名企业代表和网友在线观看网络直播、参与互动问答，企业代表和网友踊跃提问，共提出各类相关问题120多个。曾智、蔡芳模、罗妍三位同志详细解答了网友的提问，促进企业、群众知晓和享受工伤保险政策红利。 开展直播活动的同时，还在福田区园岭街道华林社区举办了“深圳新政‘单工伤’的那些事”现场宣传活动，将特定人员单项工伤保险新政策送进社区和群众，吸引了辖区企事业单位代表和劳动者近100人参加现场咨询。参加咨询的同志一对一解答叮咚买菜平台从业人员等群众所关心的“单工伤”实际问题，促进群众知晓和享受工伤保险新政策红利。 现摘录部分网友所提问题及答复如下。 网友1：特定人员的范围是指哪类人？ 工作人员：《关于单位从业的超过法定退休年龄劳动者等特定人员参加工伤保险的办法（试行）》（粤人社规〔2020〕55号）所指的特定人员，主要包括在从业单位工作的超过法定退休年龄人员、已享受一级至四级工伤伤残津贴或病残津贴人员、实习学生、单位见习人员和在家政服务机构从业的家政服务人员等未与从业单位建立劳动关系的劳动者，以及村（社区）两委人员、新业态从业人员、依法组建的志愿服务组织的志愿者。 网友2：超过法定退休年龄的人员，从未在深圳参保，可以单项参加工伤保险吗？ 工作人员：超过法定退休年龄人员所在从业单位为深圳市（或广东省其他地市）的，可以由其所在从业单位为其办理单项工伤保险参保缴费手续。 网友3：深圳市的退休人员，在深圳市之外的企业兼职，能在深圳单项参加工伤保险吗？ 工作人员：不可以，特定人员单项工伤保险实行属地管理。如该退休人员所在公司为广东省其他地市的，可以在该公司所在地市办理单项参加工伤保险手续；所在公司为广东省之外的省市，按照该公司所在省市的工伤保险相关规定执行。 网友4：请问非深圳市学校的实习生，可以在深圳参加特定工伤保险吗？ 工作人员：非深圳市学校的实习生，可以由其所在的深圳市实习单位为其办理单项工伤保险参保缴费手续。 网友5：在异地通过平台注册并接单的新业态从业人员，已签订劳动合同，可以单项参加工伤保险吗？ 工作人员：已经建立劳动关系的人员，应当依法参加工伤保险和其他社会保险，不属于单项参加工伤保险人员范围。 网友6：如果签订的是非全日制劳动合同,员工有正式单位缴纳社保五险,还能否单项参加工伤保险？ 工作人员：已经建立劳动关系的非全日制劳动合同人员，不属于单项参加工伤保险的范围，应当由所在兼职单位为其办理兼职工伤保险参保缴费手续。 网友7：有劳动关系的临时工可以单项参加工伤保险吗？ 工作人员：已经建立劳动关系的临时工，应当依法参加工伤保险和其他社会保险，不属于单项参加工伤保险人员范围。如果属于兼职人员，用人单位应当为其办理兼职参加工伤保险手续。 网友8：互联网平台接单规定平台必须是深圳的平台吗？ 工作人员：注册地或者生产经营地在深圳的平台企业，可以按照规定为新业态从业人员办理单项参加工伤保险手续。 网友9：单项工伤保险，只是给这些特定人员一个依法享受工伤待遇的机会，并不是说企业必须要给特定人员参加单项工伤保险是吗？ 工作人员：特定人员单项参加工伤保险实行自愿参保，从业单位可以自愿在生产经营所在地为其从业人员办理单项参加工伤保险手续，缴纳工伤保险费。建议从业单位积极主动为特定人员参加单项工伤保险，以更好保障劳动者权益和分散从业单位工伤风险。 网友10：特定人员单项参加工伤保险的缴费工资基数是怎么规定的？ 工作人员：特定人员的工伤保险缴费工资基数，在上年度全省全口径从业人员平均工资的60%至300%范围内，根据特定人员月劳动报酬或补助补贴收入等情况申报。其中，作为工伤保险缴费工资基数上下限的上年度全省全口径从业人员月平均工资执行时间从当年7月1日至次年6月30日止；2021年4月1日至6月30日，申报缴费工资范围为4053.6元至20268元。 网友:11：建筑工地流动工人可以单项参加工伤保险吗？ 工作人员：工程建设项目使用的超过法定退休年龄劳动者等特定人员，按照工程建设项目参加工伤保险的相关规定执行，由施工承包单位办理工程建设项目工伤保险参保缴费手续，工伤保险涵盖该工程建设项目所使用的劳动者。 网友12：特定人员单项参加工伤保险，可以补缴吗？ 工作人员：特定人员单项参加工伤保险不实施补申报和补缴工伤保险费，也不予退费。 网友13：特定人员单项工伤保险的申报时间和缴费时间是怎么规定的？ 工作人员：我市特定人员单项工伤保险参保申报周期为上月21日至当月20日，缴费周期为当月21日至次月20日。如未按规定缴费，已申报的工伤保险关系不生效，每月21日自动作废上月缴费台账。 网友14：可以多家单位同时为特定人员参加工伤保险吗？ 工作人员：未建立劳动关系的特定人员，同时在两个或以上单位从业的，各从业单位可分别为其办理单项工伤保险参保缴费手续。已参加基本养老保险的职工，同时在其他单位工作的，允许其他单位为其办理单项（或者兼职）参加工伤保险。 网友15：参加单项工伤保险的特定人员发生工伤是否影响单位的工伤浮动费率？ 工作人员：特定人员单项工伤保险直接适用从业单位的行业基准费率和单位浮动费率，特定人员工伤发生等相关情况也纳入单位浮动费率考核范围。 网友16：实习学生在实行单位属地及学校属地都同时参加了特定人员工伤保险，当实习学生在实习单位发生了工伤事故，此实习学生应在何地申报工伤？ 工作人员：可以向参保所在地的社会保险行政部门申请工伤认定，据实告知相关参保情况，但同一工伤事故，不能重复进行工伤认定，也不能重复享受工伤保险待遇。 网友17：单位员工利用下班时间在网约车平台企业兼职从业，该平台企业为其参加了单项工伤保险，如果该员工在兼职接客时发生工伤事故，是由平台企业申请工伤认定吗？ 工作人员：平台企业、兼职员工及其近亲属、工会组织可以作为申请主体，向参保地社会保险行政部门申请工伤认定。 网友18：已经参加单项工伤保险的外卖配送员和快递员在配送途中发生交通事故，本人承担交通事故主要责任或全部责任，是否可以申请工伤认定？是否属于工伤情形？ 工作人员：此种情形可以申请工伤认定。单项参加工伤保险的新业态从业人员，在工作时间和工作场所内，因工作原因受到交通事故伤害，如果没有醉酒或者吸毒、自残或者自杀、故意犯罪等情形的，则属于工伤情形的范畴。 网友19：单项参加工伤保险的特定人员申请工伤认定，需要提供劳动关系证明吗？ 工作人员：单项参加工伤保险的特定人员申请工伤认定，无需提供劳动关系证明材料。 网友20：特定人员单项参加工伤保险，是否可以作为确认双方劳动关系的依据？ 工作人员：从业单位为其从业人员单项参加工伤保险的，不作为确认双方劳动关系的依据。
