Announcement No. 31 of 2024 of the Ministry of Commerce, General Administration of Customs, and Equipment Development Department of the Central Military Commission Announcement on Optimizing and Adjusting UAV Export Control Measures

根据《中华人民共和国出口管制法》《中华人民共和国对外贸易法》《中华人民共和国海关法》有关规定，为维护国家安全和利益，经国务院、中央军委批准，决定调整特定无人驾驶航空飞行器及其相关物项的出口管制措施。有关事项公告如下：<br> 一、满足以下特性的物项，未经许可，不得出口：<br> （一）最大持续功率超过16千瓦（kW）的专门用于特定无人驾驶航空飞行器或无人驾驶飞艇的航空发动机（参考海关商品编号：8501200010、8501320010、8501330010、8501340010、8501400010、8501520010、8501530010、8407101010、8407102010、8408909230、8408909320、8411111010、8411119010、8411121010、8411129020、8411210010、8411221010、8411222010、8411223010、8411810002）。<br> （二）满足一定技术指标的专门用于特定无人驾驶航空飞行器或无人驾驶飞艇的载荷，包括红外成像设备、合成孔径雷达、用于目标指示的激光器和惯性测量设备。<br> 1.具有以下所有特性的红外成像设备（参考海关商品编号：8525891110、8525892110、8525893110）：<br> （1）波长范围在780纳米（nm）至30000纳米（nm）之间；<br> （2）瞬时视场角（IFOV）小于2.5毫弧度（mrad）。<br> 2.作用距离大于5千米（km），且具有以下任一特性的合成孔径雷达（SAR）（参考海关商品编号：8526109011）：<br> （1）条带模式分辨率优于0.3米（m）；<br> （2）聚束模式分辨率优于0.1米（m）。<br> 3.可在高于55摄氏度（℃）环境中稳定工作，且具有以下所有特性的用于目标指示的激光器（参考海关商品编号：9013200093）：<br> （1）免温控型；<br> （2）能量大于80毫焦（mJ）；<br> （3）稳定度优于15%；<br> （4）光束发散角小于0.3毫弧度（mrad）。<br> 4.具有以下所有特性的惯性测量设备（参考海关商品编号：9014209014）：<br> （1）航向精度小于2度（°）；<br> （2）姿态精度小于0.5度（°）；<br> （3）分辨率小于0.1度（°）。<br> （三）专门用于特定无人驾驶航空飞行器或无人驾驶飞艇，且具有下述任一特性的无线电通信设备（参考海关商品编号：8517629910、8517691002、8526920010）：<br> 1.无线电视距传输距离大于50千米（km）；<br> 2.一站控多机能力大于10架。<br> （四）民用反无人机系统：<br> 1.干扰范围大于5千米（km）的反无人机电子干扰设备（参考海关商品编号：8543709960）；<br> 2.专门用于反无人机系统的输出功率大于1.5千瓦（kW）的高功率激光器（参考海关商品编号：9013200093）。<br> 技术说明：“特定无人驾驶航空飞行器或无人驾驶飞艇”是指满足商务部、海关总署公告2015年第31号（《关于加强部分两用物项出口管制的公告》）中1.1款所列条件的无人驾驶航空飞行器或无人驾驶飞艇。<br> 二、对于未列入出口管制清单或者未实施临时管制的所有无人驾驶航空飞行器，出口经营者明知或者应当知道出口将用于大规模杀伤性武器扩散、恐怖主义活动或者军事目的的，不得出口。违反规定的，按照《中华人民共和国出口管制法》第三十四条处罚。<br> 三、出口经营者应按照相关规定办理出口许可手续，通过省级商务主管部门向商务部提出申请，填写两用物项和技术出口申请表并提交下列文件：<br> （一）出口合同、协议的原件或者与原件一致的复印件、扫描件；<br> （二）拟出口物项的技术说明或者检测报告；<br> （三）最终用户和最终用途证明；<br> （四）进口商和最终用户情况介绍；<br> （五）申请人的法定代表人、主要经营管理人以及经办人的身份证明。<br> 四、商务部应当自收到出口申请文件之日起进行审查，或者会同有关部门进行审查，并在法定时限内作出准予或者不予许可的决定。<br> 对国家安全有重大影响的本公告所列物项的出口，商务部会同有关部门报国务院批准。<br> 五、经审查准予许可的，由商务部颁发两用物项和技术出口许可证件（以下简称出口许可证件）。<br> 六、出口许可证件申领和签发程序、特殊情况处理、文件资料保存年限等，依照商务部、海关总署令2005年第29号（《两用物项和技术进出口许可证管理办法》）的相关规定执行。<br> 七、出口经营者应当向海关出具出口许可证件，依照《中华人民共和国海关法》的规定办理海关手续，并接受海关监管。海关凭商务部签发的出口许可证件办理验放手续。<br> 八、出口经营者未经许可出口、超出许可范围出口或有其他违法情形的，由商务部或者海关等部门依照有关法律法规的规定给予行政处罚。构成犯罪的，依法追究刑事责任。<br> 九、本公告自2024年9月1日起正式实施。商务部 海关总署 国家国防科工局
