各区、县人民政府，市政府各委、办、局：<br>
为了切实、有效地调控本市房地产市场，根据《上海市房地产登记条例》和《上海市房地产转让办法》的有关规定，现就预售商品房转让问题作出如下决定：<br>
一、自2004年4月26日起，预购人购买的预售商品住房应当在竣工并取得房地产权证后进行转让，并按规定办理房地产转移登记；在取得房地产权证前，房地产登记机构不予办理预售商品住房转让的预告登记。<br>
除商品住房外的其他商品房在未竣工并取得房地产权证前，预购人进行转让的，可以按规定办理预售商品房转让的预告登记。<br>
二、在2004年4月26日前已办理预售商品住房的预告登记并已签订商品住房预售合同权益转让协议，在2004年5月31日前提出预售商品住房转让的预告登记申请的，由房地产登记机构按原规定受理。<br>
