市市场监督管理局： 高瞻等20名委员提出的《关于对三年疫情防控期间涉企轻微失信违规行为施行统一宽缓救济措施，提振中小微企业恢复发展信心的提案》（提案第20230291号），由贵单位主办，我局会办。经认真研究，我局现将会办意见函复如下： 为推进涉企轻微失信违规行为宽缓救济，提振企业发展信心，市应急管理局积极推动包容审慎监管,修订应急管理行政处罚自由裁量权实施标准，进一步指引执法人员规范行使自由裁量权。探索建立轻微违法行为容错纠错机制，制定行政执法免行政处罚清单，明确16项轻微违法行为免处罚情形，实现法律效果和社会效果相统一。印发《深圳市应急管理部门安全生产信用信息修复工作指引》，引导失信企业主动纠正违法行为、及时消除不良影响、重塑良好信用。鼓励基层执法部门，结合案件实际情况，主动依法适用《中华人民共和国行政处罚法》第三十三条的规定，积极回应社会关切和企业发展需求，持续打造法治化营商环境。 此函。 深圳市应急管理局 2023年4月22日
